EU AI Act Article 50: The Four Transparency Requirements

These four obligations are now legally enforceable with fines attached.

Art. 50(1)

Chatbot disclosure

AI systems that interact directly with users must inform them they are talking to an AI, unless it is obvious from the context. This applies before or at the start of the first interaction.

Applies to: Any website with a chatbot, virtual assistant, or AI live chat

Art. 50(2)

Deepfake disclosure

Synthetic media of real, identifiable people — including AI-generated images, video, or audio — must carry a clear disclosure that the content is artificially generated.

Applies to: Media, marketing, and entertainment websites publishing AI-generated people

Art. 50(3)

Emotion recognition notice

AI systems that analyze facial expressions, voice patterns, or behavioral signals to infer emotions must notify users before they are exposed to such analysis.

Applies to: Sites using behavioral or biometric AI for personalization

Art. 50(4)

AI content labeling

AI-generated audio, image, video, or text content designed to appear authentic must carry a machine-readable label indicating it is artificially generated or manipulated.

Applies to: Sites publishing AI-generated content that could be mistaken for human-created

Frequently Asked Questions

What is the EU AI Act and when does it apply to websites?

The EU AI Act (Regulation (EU) 2024/1689) is the world's first comprehensive AI regulation. For most websites, the relevant chapter is Article 50, which covers transparency obligations for 'limited-risk' AI systems — chatbots and AI-generated content. Article 50 became enforceable on August 2, 2026.

Does the EU AI Act apply to my website if I'm outside the EU?

Yes. Article 2 of the EU AI Act gives it extraterritorial scope — the same mechanism GDPR uses. If EU users can access your website and interact with your AI systems, the regulation applies to you regardless of where your company is located.

What does Article 50 require from a website with a chatbot?

Article 50(1) requires that users be informed they are interacting with an AI system, unless this is obvious from context. The disclosure must be given before or at the start of the first interaction. A clear label in the chat interface — not buried in terms of service — is the standard approach.

What are the fines for EU AI Act violations?

For Article 50 transparency violations, the maximum fine is €15 million or 3% of global annual turnover, whichever is higher. Enforcement is handled by national market surveillance authorities in each EU member state.

What's the difference between EU AI Act compliance and GDPR compliance?

GDPR covers personal data processing — consent, data transfers, privacy rights. The EU AI Act covers AI transparency obligations — disclosures to users, risk classification, documentation. For most websites using AI, both apply simultaneously and overlap significantly.

Does AI-assisted content (edited by a human) need to be disclosed?

Article 50(4) specifically targets AI-generated content 'designed to appear authentic.' Content where AI played a significant role in generation — not just spell-checking — and which users would reasonably assume is human-created requires disclosure. Content with minimal AI involvement and heavy human editing is in a grey area.

How do I check if my website is EU AI Act compliant?

A compliance check should cover: (1) whether chatbots identify themselves as AI, (2) whether AI-generated content is labeled, (3) whether your privacy policy discloses AI tools, and (4) whether your AI policy page documents your AI usage. SiteProof AI's automated scanner checks all of these across your website's pages.
